STANDARD TESTING AGREEMENT FOR FRUIT PLANT MATERIAL DEVELOPED BY EUFRIN WORKING GROUP |

| Abstract:
The EUFRIN working group “Apple and Pear Variety Evaluation” has developed a standard experimental contract for variety testing purposes. Since July 1st, 2007, all European Fruit Research Institutes who are formal members of the a.m. working group, shall only use this standard pattern for future agreements about testing of new varieties and offer this contract pattern to all breeders and licence-holders. Principles of the testing agreement amongst others are the evaluation of horticultural merits of varieties after a proven EUFRIN descriptor list. The contract compromises a non-propagation agreement and rules the transmission of testing results and information including confidential clauses for the first testing years and the possibility of publishing after several years or after advertisement, salaries, or with delay of one year after EU-PVR application. The plant material and all related rights remain property of the breeder. Testing results shall remain property of the testing station. Transmission of testing results will be possible at any time after written request, and visiting of the testing station, of course, shall be possible during business hours after previous announcement. The use of pollen for further breeding activities is according to worldwide standards of UPOV-rules. Because no financial compensation is given for the standard testing work (except receiving the material free of charge), the presented agreement is a fair balance between the legitimate interests of the breeder and the interest of the testing station.
