PUBLICATION, REGISTRATION AND PROTECTION OF ORNAMENTAL PLANT CULTIVARS IN CHINA

Abstract:
More than 100 new cultivars of ornamental plants are bred in China annually, only some of which are published in academic, technical or gardening journals, or in gardening newspapers. Monographic books on Prunus mume, Paeonia, and Nelumbo nucifera are the most important existing publications related to cultivars in China. There are now International Cultivar Registration Authorities (ICRAs) for Prunus mume and Osmanthus in China, who have registered most of the cultivars including traditional and newly-bred ones. On the other hand, few Chinese cultivars of Paeonia and Nelumbo nucifera have been registered by ICRAs outside China. There are only 14 genera or species of ornamental plants in the list open for applications for Plant Breeders’ Rights (PBR) protection in China, with more than half of the applications coming from overseas. Misunderstandings and lack of information about procedures for the registration and protection of new plant cultivars in China need to be addressed.
