PLANT BREEDERS' RIGHTS FOR STRAWBERRY CULTIVARS

Abstract:
Plant Breeders' Rights (PBR) protect the developer against unauthorized propagation and marketing of his/her cultivars. For strawberries, they are granted by a national PBR-office or, if the aim is a protection all over Europe at once, by the Community Plant Variety Office (CPVO), after two years of field trials. In the course of these trials it is determined whether the requirements for PBR, novelty, distinctness, uniformity and stability, are fulfilled. Therefore various characteristics are observed or measured according to internationally valid guidelines, which are edited by the International Union for the Protection of New Varieties of Plants (UPOV) in Geneva, Switzerland.
