Abstract:
Cultivar names and trademarks used to indicate the source of origin of plants sold in the marketplace must coexist.
Cultivar names are set off with single quotes and should be freely usable worldwide to identify a particular variety.
Trademarks may be applied to plants of the variety to denote the origin of the plant if distinguished from the cultivar name and may not be used in commerce without authorization of the trademark owner.
